YORK, ƒ s.} To Stephen Furbish one of the Surveyors

of Highways in the town of Kittery.

GREETING.

WHEREAS the Inhabitants of the town of Kittery, at a public

meeting thereof regularly notified and warned, in April 1 did vote and raife a fum

of money, to be expended in materials and labor, on the high-ways and town-ways in faid town;

and the Affeffors for faid town have affeffed the fame on the polls and ratable eftates, as other

town taxes are affeffted : Part of which is affeffed upon perfons named in the lift hereunto

annexed; to be expended within the limits affigned you for repair and amendment. You are

hereby directed to give fix days notice (in writing if difired) extraordinary cafualities excepted,

to each perfon in your lift, of the fum he is affeffed as aforefaid, and of the time and places you

appoint for providing materials and laboring, to the end each perforn may have opportunity to

work out the fame in perfon, or by his fubftitute, or with oxen, cart or plough, as you in your

diferetion fhall affign or appoint, at the rates and prices the town have fixed for fuch labor,

(which prices are mentioned in faid affeffment) and you are directEd to lay out and expend

one half at the leaft, of the sum affeffed in your lift, before the firft day of June next,

and the remainder at or before the first day of Oct next And if any perfon in

your lift aforefaid, fhall neglEct or refute to pay, in labor or otherways, within the time limited

as aforefaid, the fums they are refpEtively affeffed, you are in the name of the Commonwealth

of Maffachufetts, to diftrain the goods and chattles of fuch perfon to the value thereof; and

the diftrefs fo taken to keep for the fpace of four days, at the coft and charge of the owner; and

if he fhall not pay the fum remaining due on his affeffment within the four days, then you are

to fell at public vendue, the diftrefs fo taken for the payment thereof with charges ; firft giv-

ing forty hours notice of fuch sale, by putting up advertifments thereof, in fome public

place in the town of Kittery ; and the overplus fifing by fuch fale (if any there be) befides the

fums due on the affeffment, with neceffary charge of taking and keeping the diftrefs, you

are immediatley to reftore to the owner : And for want of goods or chattels whereon to

make diftrefs, (besides tools or implements neceffary for his trade or occupation, beafts of the

plough neceffary for the cultivation of his improved land, arms, utenfils for houfe-keeping

neceffary for upholding life ; bedding and apparel neceffary for himfelf and family) for the

space of twelve days, you are to take the body of fuch perfon fo negecEting or refufing, and

him commit unto the common Jail of the county, there to remain until he pay the fame,

or sufh part thereof as fhall not be abated by the affeffors for the time being, or the Court

of General Seffions of the peace for the faid county : And you are further dierEted on the

first monday of April ~ next ; to render an account to the SelEctmen,

of all the monies expended on the high-ways in your limits : And at the expiration of your

term, to pay over to the Town-Treafurer for the time being, all fuch monies, as fhall remain in

your hands unexpended.
 

Given under our Hands and Seals, agreeable to the directions of the law, and the votes of faid

Town, the 6 th, day of May . , in the year 1805~
